Applied Radio Labs (ARL) Standard Terms of Sale

Payment

The forms of payment accepted by ARL are published on the website www.radiolab.com.au . ARL reserves the right not to accept credit card payment on any transaction.

Special Conditions

If the customer's order form contains special conditions, the order will only be accepted by ARL on the understanding that these conditions are not at variance with those of ARL, or if there is any variance, that such conditions have been waived by the customer.

Liability

The customer is responsible for ensuring that the product is suitable for their application, and nothing provided by ARL is to be considered as professional advice in this regard. In the case of errors or omissions in the information provided by ARL, whether or not caused by negligence, the total liability of ARL to the customer will be limited to refunding the purchase price. 

Limitation of Liability

ARL will not be liable under any circumstances for any consequential damages, lost profits, expenses or other losses arising from or related to the sale or use of any of its products. The customer agrees to indemnify ARL against such liability.

Intellectual Property

ARL does not warrant that the products and designs do not infringe the patent or other intellectual property rights of third parties.

Special Conditions for Design Packs

Licence to Use

In return for the sale price, ARL grants the customer organization a royalty free licence to use the design pack technology. Under this licence the customer organization may incorporate the technology into multiple products and designs and sell products containing the technology. The customer agrees to treat the design pack technology as commercial-in-confidence, not to release it to third parties without the prior permission of ARL, and not publish or otherwise place it in the public domain without the prior permission of ARL.

Refunds

In general there are no refunds given on design packs unless it can be demonstrated that ARL has misled the customer in some way in the information provided about the design pack.
